Iraq rejects US extradition for terror commander

BAGHDAD (AP) ? An Iraqi court has rejected a request to send a terror commander to the United States for trial, a decision that apparently ends the Obama administration's efforts to prosecute the Lebanese Hezbollah figure held in Iraq for the 2007 killings of five American soldiers.

The U.S. believes Ali Mussa Daqduq is a top threat to Americans in the Mideast, and had asked Baghdad to extradite him even before two Iraqi courts found him not guilty of masterminding the 2007 raid on an American military base in the holy Shiite city of Karbala.

But the July 30 decision by the Iraqi central criminal court, a copy of which was obtained by The Associated Press, ordered that Daqduq be freed immediately. It also makes it clear that Iraq believes the legal case against Hezbollah commander is over.

"It is not possible to hand him over because the charges were dropped in the same case," the three-judge panel ruled. "Therefore, the court decided to reject the request to hand over the Lebanese defendant Ali Mussa Daqduq to the U.S. judiciary authorities and to release him immediately."

The U.S. Embassy in Baghdad declined to comment Thursday and referred questions about the case to Washington.

In an AP interview last month, the national security adviser to Vice President Joe Biden said the White House also has asked Iraq's highest appeals court to review and overturn its June 25 order to free Daqduq. It was not immediately clear Thursday whether that review was continuing.

Daqduq's lawyer, Abdul-Mahdi al-Mitairi, said the militant is still being held under house arrest in Baghdad's heavily fortified Green Zone. But he said he will push to have Daqduq released before the end of Ramadan, the ongoing holy Muslim month that ends later in August.

Washington believes the Lebanese-born Daqduq worked with Iranian agents to train Shiite militias to target the U.S. military during the years of sectarian violence that gripped Iraq over the last decade. His case has illustrated the tricky aftermath of the long U.S. military campaign in Iraq that ended last year and has elements of both Iraqi and U.S. internal politics.

Daqduq was detained for more than four years by the U.S. military before it left Iraq last December. He was handed over to Iraqi authorities as required when the troops left, and amid a debate between the Democratic White House and Republicans in Congress over whether high-risk terror suspects should be brought to the U.S. for trial.

Republican lawmakers said Daqduq was too much of a public threat to be incarcerated on American soil, and wanted him to be held at the contentious military detention center at the Navy base on Guantanamo Bay in Cuba. President Barack Obama refused. He has promised to close the detention center at Guantanamo, which became a worldwide symbol of detainee abuses during the Republican administration of President George W. Bush.

Since then, two Iraqi courts have cleared Daqduq of the terrorism and forgery charges that Iraq's government lodged against him. The new court order says the Pentagon issued the extradition request but did not specify when.

Iraqi government officials privately acknowledge they have little, if any, legal basis for continuing to detain him.

The Obama administration came into office pledging a new relationship with Africa focused more on private investment, democracy-building, and security cooperation than on handouts. But America's own economic troubles and its focus on Asia have meant the new policy has been more one of words than action, some Africa experts say.

One result is that China has been left to solidify its place as the preeminent major-power investor in Africa at a time of rapid growth across much of the continent.

?The [Obama] administration is coming a bit late ? even with this new strategy there?s a sense that ? it?s really not sufficient,? says Mwangi Kimenyi, director of the Africa Growth Initiative at the Brookings Institution in Washington. ?There?s a disappointment in terms of what could have been done.?

Secretary Clinton kicked off her trip in Senegal Wednesday, where she touted how the West African country overcame political tensions earlier this year to elect a new president. But too many Africans, she said, still live under ?autocratic rulers who care more about preserving their grip on power than promoting the welfare of their citizens.?

In a speech in the capital of Dakar, Clinton previewed her Africa trip ? her fourth as chief US diplomat ? saying she would focus on the ?partnership, not patronage? policy that President Obama unveiled in his 2009 speech in Ghana. ?I will be talking about what that means ? about a model of sustainable partnership that adds value, rather than extracts it,? she said.

That comment seemed to refer to China, which has increasingly turned to Africa in recent years to supply the raw materials for its economic boom.

?The days of having outsiders come and extract the wealth of Africa for themselves, leaving nothing or very little behind, should be over in the 21st?century,? Clinton said.

One goal of Clinton?s trip will be to highlight Africa?s recent progress ? from continuing economic growth in the midst of a global downturn and a rise in consumer spending, to signs of a growing political maturity in some countries ? and thus to pique the interest of American investors in a continent they have often shunned.

Obama pitches tax cuts as pocketbook issue in Ohio

(AP) ? Dueling with Republicans on taxes, President Barack Obama is urging the House to pass a tax cut for households earning less than $250,000 a year and drawing a bright line with rival Mitt Romney on a pocketbook issue for voters.

Obama was making campaign stops in Republican-friendly Mansfield and the Democratic stronghold of Akron on Wednesday, rallying voters after a week of low-profile fundraisers and formal speeches in the aftermath of the deadly shooting at a movie theater in Aurora, Colo.

The president looked to reprise the middle-class tax debate as Romney wrapped up a three-country foreign trip and the monthly jobs report loomed on Friday. The House on Wednesday is expected to consider Obama's plan to extend President George W. Bush's tax cuts for individuals earning less than $200,000 and couples making less than $250,000, along with a Republican proposal to extend the tax cuts for everyone.

Taxes have become a defining issue in the presidential race, and the outcome of the tax debate isn't expected to be decided until after November. With less than 100 days before the election, the campaign remains tight, with both campaigns trying to pump up their core supporters while competing for a narrow slice of undecided voters in about eight states that could tip the election.

Obama's campaign released a new ad Tuesday focused on taxes and the deficit, calling Romney's approach a way to provide a "new $250,000 tax cut for millionaires." The ad said Romney's approach on tax cuts, coupled with increased military spending, would add "trillions to the deficit."

"To cut the deficit we need everyone to pay their fair share," Obama said in the ad's tag line, looking into the camera. The spot was airing in Colorado, Iowa, New Hampshire, Nevada, Ohio and Florida, part of what detailed advertising records show is a heavy investment in the range of $30 million during August.

Romney campaign spokesman Ryan Williams called it a "ridiculous ad coming from a president who shattered his pledge to cut the deficit in half by the end of his first term."

Obama has repeatedly pressed for the one-year tax extension, arguing that it would provide relief for families and certainty for businesses wary of hiring workers at a time of concerns over the global economy. The White House says it would provide an average of $1,600 a year in tax cuts for more than 100 million families.

Republicans say allowing taxes to rise on higher earners will hurt business owners who create jobs. The Senate approved a Democratic bill based on Obama's proposal, but the measure stands no chance in the Republican-led House. Romney has proposed cutting taxes for everyone, including the wealthy, and making the Bush tax cuts permanent.

The issue has created both a policy and personal tug of war, with Democrats calling on Romney to release more of his income tax returns. Romney, who would be among the nation's wealthiest presidents if elected, has released just one year of personal income tax returns and promised to release a second but no more.

Home from meetings with foreign leaders in Britain, Israel and Poland, Romney released a new television commercial designed to introduce him to voters in battleground states who know little or nothing about his personal background.

In the ad, Romney speaks of his years in private business, in government and as the head of the Olympic Games in Salt Lake City a decade ago, saying, "I want to use those experiences to help Americans have a better future." It followed weeks of efforts by Obama's team to define Romney as a wealthy financier whose private equity firm benefited at the expense of workers.

Romney was spending Wednesday in private meetings at the campaign's Boston headquarters as speculation swirls about the selection of his running mate. The campaign is preparing to ramp up his public schedule in the weeks leading up to the Republican National Convention in Tampa, Fla., at the end of August.

Obama's ninth trip of the year to Ohio was taking him to Mansfield, home to many small auto suppliers and manufacturers, and Akron, the nation's longtime tire and rubber capital. Obama carried Ohio in 2008 with 52 percent.

Richland County, where Mansfield is located, has been fertile territory for Republican presidential campaigns going back to Ronald Reagan, and John McCain beat Obama in the county by a wide margin in 2008. But Obama's team views the region north of Columbus as open to his record on taxes and manufacturing, helped by Obama's rescue of automakers General Motors and Chrysler in 2009. General Motors posted record profits last year.

The Romney campaign on Wednesday released a TV ad attacking Obama's support for the auto industry bailout. The ad highlights an Ohio General Motors dealer who was forced to close in 2009, and blames the Obama administration for dealership closures across the state.

The auto bailout was enacted by President George W. Bush in 2008 and continued under the Obama administration. Romney previously argued that the nation's auto companies should be left to go through bankruptcy without government assistance.

Ahead of Obama's arrival, Sen. Rob Portman, R-Ohio, a potential vice presidential pick for Romney, said the president's budget plan threatened the C-27J cargo aircraft and hundreds of Air National Guard jobs based at the Mansfield airport, where Obama was landing.

The Pentagon budget proposal has called for a cut of about 5,000 from the Air National Guard as well as 134 aircraft, including four C27-J aircraft based in Mansfield. The Pentagon plan has met stiff resistance from the nation's governors and members of Congress.

White House spokesman Josh Earnest said Obama is "committed to working with the Department of Defense to find a mission for Mansfield Lahm Air National Guard Base."

Iran unfazed by Israeli, US threats of force: Netanyahu

US and Israeli threats of a military strike have done nothing to stop Iran's pursuit of a nuclear capability, Israeli Prime Minister Benjamin Netanyahu said on Wednesday in talks with US Defence Secretary Leon Panetta.

"You yourself said a few months ago that when all else fails, America will act. But these declarations have also not yet convinced the Iranians to stop their programme," Netanyahu told the Pentagon chief.

"This must change, and it must change quickly because time to resolve this issue peacefully is running out."

Panetta issued his own warning to Iran over its efforts to develop what Israel and much of the West believe is a bid for military nuclear capability.

"They have a choice to make," he told reporters on a visit to an Iron Dome missile defence battery in the southern port town of Ashkelon with Israeli Defence Minister Ehud Barak.

"They can either negotiate in a way that tries to resolve these issues and has them abiding by international rules and requirements and giving up their effort to develop their nuclear capability.

"But if they don't, and if they continue to make the decision to proceed with a nuclear weapon ... we have options that we are prepared to implement to ensure that does not happen."

Israel, the sole if undeclared nuclear power in the Middle East, has repeatedly warned that a nuclear Iran would pose an existential threat to it, and both Israeli and US officials have repeatedly warned that all options -- including a military strike -- were on the table for preventing such a scenario.

"You recently said that sanctions on Iran are having a big impact on the Iranian economy, and that is correct," Netanyahu told Panetta. "But unfortunately it is also true that neither sanctions nor diplomacy have yet had any impact on Iran's nuclear weapons programme.

And until now, Iran had not taken seriously US or Israeli threats of a military strike on its uranium enrichment facilities, he said.

"However forceful our statements, they have not convinced Iran that we are serious about stopping them," said Netanyahu who has repeatedly warned that a military action may be necessary.

On Tuesday, the Israeli leader said he had not yet decided whether to mount a military strike on Iran's enrichment facilities.

But he also said Israel would not rely on anyone else to guarantee its security -- not even Washington.

Panetta reiterated US pleas for more time to let diplomacy and sanctions work before considering a strike.

"We have to exhaust every option, every effort before we resort to military action," he said in Ashkelon.

"It is my responsibility as secretary of defence to provide the president with a full range of options, including military options should diplomacy fail," he added.

Asked how the Obama administration would react in the event of a unilateral Israeli strike, Panetta said that the question of what was in Israel's national security interest "is something that must be left up to the Israelis."

Barak said it was extremely unlikely that sanctions and diplomacy would convince Iran to abandon its nuclear ambitions, which Tehran insists are peaceful.

"The probability of this happening is extremely low," he remarked, noting that Iran was pushing ahead with daily enrichment of "uranium needed for their weapon."

"We have clearly have something to lose by this stretched time," he remarked.

Speaking ahead of his arrival in Israel, Panetta ruled out talks on "potential attack plans" with the Israelis.

"I think it's the wrong characterisation to say that we're going to be discussing potential attack plans," he said in Cairo. "What we are discussing are various contingencies on how we would respond."

Washington, he said, was continuing to "work on a number of options in that area." He did not give further details.

Panetta also met on Wednesday in Jerusalem with Israeli President Shimon Peres who said Iran is "the only country that is both imperialist and threatening to destroy another country."

"It is not just a theoretical wish, it is supported by terror, by intervention in the affairs of other countries and the development of a nuclear bomb," Peres's office quoted him as telling his guest. "We cannot live in a world with imperial ambition and nuclear weapons and no laws, no limitations, no respect."
